Mclean County Chamber Federal DOL Update

DOL Releases Final $35K Overtime Rule
This week, the Department of Labor (DOL) released its final rule on salaried workers overtime thresholds.  As the Chamber has been reporting, the final threshold will be $35,568 per year.  The rule will also raise the threshold for highly compensated employees to $107,432.

Put simply - starting January 1, 2020 - employers will have to pay time and a half for salaried employees who make under $35,568 who work more than 40 hours per week; see the Final DOL $35K Salaried Employee Overtime Threshold here.

Along with the rule, the DOL also published a fact sheet for guidance on compliance for workers, employers, exemptions, etc.; see the DOL Fact Sheet here.

While there still may be some challenges to the rule, it has been, on the whole, embraced as a more reasonable approach than the 2016 threshold proposed and stopped by court order under the Obama Administration.  Employers would be wise to review their policies to prepare for the January 1 implementation date.
